Filing a Workers’ Compensation Claim
If you are injured on the job, there are certain steps you should take in order to successfully file a claim for workers’ compensation.
- Report the injury to the employer. No matter how small the injury may seem, report it to your employer. If possible, submit the report in writing and keep a copy for your records.
- Complete a claim form. Regardless of how an employer learns of an accident, they are required to immediately offer the injured employee a claim form for workers’ compensation. The employer has no obligation to provide benefits unless the claim form is completed. Make sure that you fill out the form completely, accurately, and including specific information. Keep a copy of this claim for your records. It is your employer’s responsibility to immediately contact their worker’s compensation insurance company and secure medical attention for your injury.
- File the claim as soon as possible. You should act quickly to claim your workers’ compensation benefit. Any delay can lead to potential problems. Reporting your injury and filing a claim quickly increases the chances that your benefits will begin quickly. By the same token, delays in reporting can lead to delays in benefit payments. If your claim is delayed or disputed, immediately contact the workers’ compensation commission for your state. Workers’ compensation law and benefits vary widely, depending on your state’s laws.
The best way to determine responsibility for your injury and ensure that your workers’ compensation claim is complete is to consult an attorney with experience in cases involving workers’ compensation and construction accidents. Your lawyer will work with you to make sure all the steps are followed and that you understand your legal rights.
