Q: If a person is injured by debris from a construction site while on another property or a public sidewalk, who is liable?

A: The construction contractor is responsible for taking reasonable steps to keep areas near the construction site free of debris. If the contractor does not do so, the injured person will be able to recover damages in some instances. Contractors should also inform pedestrians and others traveling past the construction site that they can be injured if they stray into the construction area. Signs are generally not considered sufficient warning: some hazards, such as a pit, must be marked by barriers and warning lamps. Failure to take these precautions can make a contractor liable for injuries.
